Friendor Terms of Service
1. Agreement
These Terms of Service ("Terms") govern your use of Friendor, a mobile application published by Jose Negrete ("Friendor," "we," "us"). By creating an account or using the app, you agree to these Terms and the Privacy Policy. If you do not agree, do not use Friendor.
2. Who Can Use Friendor
You must be at least 17 years old and legally capable of entering into a contract. Friendor is intended for professional wedding and event vendors — photographers, videographers, DJs, planners, florists, hair & makeup artists, caterers, officiants, coordinators, photo booth operators, and adjacent creative pros.
3. Your Account
You are responsible for the security of your account and for everything that happens under it. Provide accurate information; keep it current. You may delete your account at any time from the app's Help menu → Delete Account…, and your profile, posts, and messages will be removed from production within 30 days.
4. User Content
You retain ownership of the content you post — gigs, portfolio images, applications, comments, and direct messages ("Your Content"). By posting Your Content, you grant Friendor a worldwide, non-exclusive, royalty-free license to host, display, transmit, and back up Your Content solely to operate the app. This license ends when you delete the content or your account, except where retention is required by law or embedded in cached/backup copies awaiting rotation.
You represent that Your Content does not infringe anyone's rights and complies with these Terms.
5. Community Rules
The following are prohibited on Friendor and will result in content removal and/or account termination:
- Harassment, threats, hate speech, or targeted abuse.
- Sexual content, nudity, or content sexualizing minors.
- Fraud, scams, phishing, or impersonation of another vendor or business.
- Off-platform payment schemes designed to defraud (unpaid work bait, chargeback traps, escrow bypass fraud).
- Spam, unsolicited mass messaging, or unauthorized commercial promotion outside your own gig posts.
- Illegal activity, or content that violates a third party's copyright, trademark, or right of publicity.
- Uploading someone else's portfolio, brand assets, or client photos without their permission.
- Circumventing safety features (report, block, rate-limit).
6. Reporting and Blocking
Every gig, profile, and DM thread has a Report action. Submitting a report opens a case in our moderation queue. Jose reviews reports within 24 hours and takes action ranging from content removal to account termination. Blocking a user immediately hides their gigs, profile, and DMs from you, and prevents them from messaging you.
We do not tolerate content that violates Section 5. Repeat violators are terminated without refund of any optional paid features they purchased.
7. Payments (Optional)
Friendor is free to use. Certain optional features may involve payment:
- Real-world services (escrow, when available): booking payments between vendors are processed by Stripe as web checkout. Friendor takes a service fee disclosed at checkout time. These payments are for services delivered outside the app and are not processed via In-App Purchase, in line with Apple Guideline 3.1.3(e).
- In-app placements (boosts, when available): paid placement of your own gig at the top of the local feed is processed via Apple In-App Purchase. Boosts are consumable, expire 48 hours after activation, and do not confer any digital benefit outside the paid placement window.
- Supporter tier (when available): keeps the servers on. Billed via Stripe web checkout. Includes a "Friend of Friendor" badge and a lower escrow fee (5% instead of 8%) at the payee's tier. Cancel anytime.
Optional payment features may be unavailable in your region. Fees at checkout are authoritative; changes to fees will be announced before they take effect.
8. Off-Platform Handshakes
Most Friendor bookings happen off-platform — a DM, a phone call, a Venmo. Friendor does not verify or insure these transactions. Escrow (when enabled) is one optional way to add contractual and financial recourse; using it is your choice.
9. Intellectual Property
The Friendor name, logo, chrome design, and app code are owned by Jose Negrete. You may not copy or clone them.
10. Termination
You may delete your account at any time. We may suspend or terminate your account for violation of these Terms, harassment, fraud, or any other conduct that puts the community or the platform at risk. Where possible, we will provide notice; where safety is at stake, we may act first and explain after.
11. Disclaimers
Friendor is provided "as is." We do not warrant that the app will be uninterrupted, error-free, or that gigs and vendors on it will meet your expectations. Vendor quality, reliability, and completed work are between you and the other vendor. Friendor is not a party to those contracts.
12. Limitation of Liability
To the fullest extent permitted by law, Friendor is not liable for indirect, incidental, or consequential damages, or lost profits, arising out of your use of the app. Our total liability to you for any claim relating to the app is capped at the greater of USD $50 or the amount you paid Friendor in the 12 months before the claim.
13. Governing Law
These Terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Dallas County, Texas.
14. Changes
We may update these Terms. Material changes will update the "Last updated" date and be announced inside the app. Continued use after a change means you accept the updated Terms.
